But there is one aspect of New York's business formation process that catches nearly every founder off guard: the publication requirement. This guide covers everything, including that.

The Publication Requirement: What You Need to Know Before You Start

Most states require you to file paperwork and pay a fee to form an LLC. New York requires all of that, plus you must publish a notice of your LLC's formation in two newspapers for six consecutive weeks.

This is not optional. It is a legal requirement under New York State law.

How it works:

  • After your LLC is approved, you receive a notice from the NY Department of State specifying the county in which you must publish
  • You must publish in two newspapers designated by that county clerk: one daily and one weekly

The cost: This is where it gets expensive. In most counties outside New York City, publication costs a few hundred dollars total. Manhattan publication fees can run $1,200 to $2,000 or more depending on the newspapers and the length of your notice.
